Olivier Martinez has been photographed outside his Los Angeles home amid an escalating custody battle with former wife Halle Berry over their 12-year-old son, Maceo.
The French actor was seen on Monday, days after obtaining a temporary restraining order against Berry and accusing her of physically attacking their son.
Berry has strongly denied the allegations, with her lawyer describing Martinez’s court filing as “entirely meritless and deliberately misleading.”
Martinez alleges Berry choked son
In court documents filed on 1 October, Martinez claimed an altercation occurred at Berry’s home on 26 September.
He alleges the Oscar-winning actress jumped on Maceo, placed her hands around his neck and choked him during an argument.
Martinez also accused Berry of previous physical, verbal and emotional abuse and asked the court to award him sole legal and physical custody of their son.
The allegations have not been proven in court, and the temporary order does not amount to a finding that the alleged abuse occurred.
Berry denies accusations
Berry’s attorney, Marina Beck, rejected Martinez’s account and accused him of repeatedly violating court orders and interfering with therapeutic and educational arrangements for Maceo.

Beck also pointed to what she described as Martinez’s history of erratic, possessive and violent behaviour.
She said Berry remained committed to fighting for Maceo’s best interests and providing him with the support he needs.
Martinez’s lawyer, Patrick Baghdaserians, said his client’s main concern was the child’s health, welfare and safety.
Judge allows Berry to see Maceo
A Los Angeles judge granted Martinez a temporary restraining order covering him and Maceo but declined to prohibit all contact between Berry and her son.

Berry is still permitted to see Maceo during specified daytime hours on Mondays, Tuesdays and selected weekends.
The judge also rejected Martinez’s request for Berry to undergo alcohol and drug testing, finding that insufficient information had been presented to support the restriction.
The temporary arrangements will remain in effect until a further court hearing scheduled for 16 October.
Berry seeks return to shared custody
Berry has separately asked the court to restore the former couple’s previous joint-custody arrangement.
She alleges that Maceo returns from Martinez’s home angry and confrontational towards her and accuses her former husband of damaging their relationship. Martinez disputes her claims.
Berry and Martinez married in 2013 and announced their separation in 2015. Their divorce was not finalised until August 2023, when they agreed to share legal and physical custody of Maceo.
Under that settlement, Berry was ordered to pay Martinez $8,000 a month in child support, along with a percentage of income exceeding $2 million.
The former couple’s latest allegations remain disputed and are expected to be examined at the upcoming hearing.
